Rental Policy
Operating Area/Weather
The watercraft’s permitted operating area is only on the agreeed upon lake as indicated on the map and in any event no farther in distance than 1 mile from the rental location where the watercraft was picked up from Owner. Operating the watercraft outside of this area is prohibited. Owner may monitor the watercraft’s GPS locator. Hourly rental rate doubles for time spent outside the permitted operational area, renter will immediately return to dock upon observing any rain or lightning.
Boating Safety and Rules
Renter saw and read Owner’s policies and boating safety instruction and agrees to comply with those, renter and any passengers will comply with applicable Michigan boating laws and regulations, including life jacket rules, no-wake zones (e.g., within 100 feet of shore or posted), prohibitions against operating watercraft under the influence of alcohol or drugs, renter is responsible for safely operating the boat and passenger safety, renter will not operate the boat under the influence prescription drugs impairing operator’s ability, renter will not allow anyone else to operate the boat, renter will immediately report any accidents or incidents to Owner and appropriate law enforcement authorities.
Responsibility For Loss/Damage
Renter is solely responsible for damage to the watercraft or its equipment during the rental period, excluding normal wear and tear, renter is responsible for the replacement cost of damaged, lost, or stolen equipment. Owner will use security deposit to cover damages or losses. If damages or losses exceed the security deposit, renter is responsible for the balance, which may be charged to the credit card on file. Owner will conduct a pre-rental and post-rental inspection and test of the watercraft to determine compliance.
Release of Liability
Renter releases and forever discharges Owner, its officers, agents, insurers, and employees, from any and all claims, demands, actions, or causes of action arising out of or in any way related to Renter’s use of the watercraft, including but not limited to any claims for personal injury, property damage, or wrongful death. This release includes claims related to the condition of the boat or its equipment.
Indemnification
Renter will indemnify and hold harmless Owner, its officers, agents, insurers, and employees, from any claims, demands, actions, liabilities, damages, costs, and expenses (including attorney's fees) arising out of or related to the rental or use of the boat, including but not limited to any claims brought by third parties for personal injury, property damage, or wrongful death.
Arbitration
Any claims, disputes, or actions arising out of or relating to the watercraft, this agreement, or the breach of this agreement, shall be determined exclusively by arbitration administered by the American Arbitration Association (AAA) in accordance with AAA’s Commercial Rules. The arbitration shall be held in the county where the watercraft is docked prior to renting. The arbitrator's decision shall be binding on the parties and may be entered by courts holding jurisdiction.
General Rules
1. Must be 21 years of age or older to rent equipment.
2. Must be 27 years of age or older to operate a pontoon or ski boat without a boaters safety license.
3. Must be 21 years old or older to operate a wave runner.
4. Must have a valid driver’s license from a US state or territory.
5. Must have a major credit card.
6. Qualified renter must be present to complete the rental contract and liability waiver.
7. Intoxicants are strictly prohibited. Service will be refused to anyone perceived under the influence of drugs and/or alcohol. No operating under the influence of intoxicating liquor or a controlled substance.
8. No Pets.
9. All persons are informed and acknowledge that watercraft activities are potentially dangerous and agree to hold WrightWay Marine & Rentals, and all members, officers, employees and affiliated entities harmless.
10. For safety and to avoid charges to your credit card, after leaving the dock with equipment, passenger exchange is prohibited. Only registered parties on each watercraft are allowed during the entire duration of the rental.
11. Reservations are strongly recommended for watercraft (4- or 8-hour periods). Watercraft reservations are guaranteed but weather is not. Make sure the weather is to your liking before reserving. 100% payment is required to make a reservation. When you make a reservation with us, you agree to abide by our policies.
12. We charge a $25 change fee if you want to change a reservation,. Please call us at least 24 hours in advance of your reservation and we’ll switch it to a different time/date if available.
13. 100% payment deposit is required at the time of your reservation. Deposits made via credit cards only. We accept Visa, MasterCard, and Discover. All credit card transactions must be made by the person named on the card. A valid driver’s license must accompany the credit card. We will not accept credit cards from someone other than the card owner.
14. Cancellations 10 days or more before your reserved date are eligible for a deposit refund, less 10% processing fee. Cancellations made less than 10 days before your reserved date will receive no refund. Cancellations made the day of rental because weather is too dangerous to use the boat will receive a full refund (minus a $25 processing fee) or reschedule the reservation. NO SHOWS are charged in full for the reserved rental period. We may cancel your reservations for violating these policies, without a refund. We reserve the right, at our discretion, to reschedule and/or cancel your reservation in the event of inclement weather.
15. We will retain a charge in the amount of $500.00 per watercraft as a security deposit at check-in. Credit cards must match renters’ name on the reservation and rental agreement, renter is responsible for all losses and damages to equipment while in your care, up to and including replacement cost, renter is solely responsible for ensuring the safety of the passengers and vessel during the rental period. All damages or accidents must be reported to Owner, and to local law enforcement immediately, renter will have his/her damage deposit returned when the equipment is returned unharmed and on time.
16. A cleaning fee of $25 will be added to equipment returned excessively dirty.
17. NO REFUNDS FOR EARLY RETURNS. Early returns due to dangerous weather will be prorated and enter will be issued a WrightWay Marine & Rentals credit to use at a later date.
18. WrightWay Marine & Rentals has no insurance waiver to cover watercraft damages, renter is responsible for all damages incurred during rental period. Check your homeowner, auto, or credit card policy to see if there is an endorsement available to you.
19. Policies are subject to change at any time without notice. In the event that any policy is unenforceable by law, you are still bound by applicable law.
